When does it count?

Filing for a compensation or accident claim of any kind is a common practice. Because there are so many scenarios in which this applies, such as an accident at work, negligence of a third party and others, it isn’t at all rare. However, determining whether your case is eligible for compensation will depend on the situation. Here are some guidelines to help you.

First, the injury sustained must be so severe it interferes with your daily life. A simple cut that heals without fault is not grounds for financial compensation. Secondly, legal action is not granted if the possibility of injury was almost certain, such as being prescribed the wrong medication and having it caught by another professional later. Third, you will only be compensated for costs directly involved with the expenses caused by your injury. Medical bills etc. will be factored in, and the sum awarded will be determined by a specialist, and nothing more.

As for the legal expenses involved, a term such as no win no fee insures you have nothing to risk by pursuing your rights. If your case is not won, you won’t pay. In most cases, if it is won, the third party will pay for your legal aid, and not you.
